Huge Discrepancy In Reports About When Tekashi 6ix9ine Is Getting Out Of Prison

Tekashi 6ix9ine will be sentenced for racketeering on Wednesday, December 18.

There are two massively conflicting reports over how much time he is likely to get.

Lawyer Mohammed Gangat, who's been closely following the case, believes it's a done deal and 6ix9ine will be released on Wednesday as a reward for snitching and testifying against his former Nine Trey brothers.

"Why do I think it's extremely likely that the judge will sentence Tekashi 6ix9ine to time served and released him this Wednesday? That judge, he can give him 10 years, he can give him 20 years, he can give him 40 years if he wants. But, you gotta understand how our courts are structured. On the one side in the government, and they are here to prosecute crimes. On the other side is the defense attorney, and he is there to defend those accused of crimes. The judge is supposed to act as a neutral arbitrator, figure out who has a better argument, make a decision. In this case, the government is not asking for a sentence. The probation department, also part of the government, they are recommending time served. And the defense attorneys are recommending time served. So it would take something really extreme, something unprecedented for the judge to give his anything other than time served. I've been in the Southern District of New York multiple times at sentencing hearings and you hear it from judges time and time again that they put a lot of faith and lot of credit in what the probation department recommends.  Here is a case with the probation department and the defense recommending time served, I fully expect he will get time served."

On the other hand, the legal-focused gossip site The Blast has a different read on what the probation department is thinking:

Tekashi 6ix9ine is banking on his extensive help to the prosecution in convicting fellow Blood gang members, but according to a new filing in his criminal case, he is still facing 37 YEARS behind bars.

According to legal documents, obtained by The Blast, prosecutors in Tekashi's case agree with the probation department in New York in their calculation of the minimum sentence for his crimes.

One of the reasons in the filing, for such a long sentence, is the fact Tekashi was on probation for a sexual misconduct charge while still running with the Nine Trey Bloods. Tekashi was charged with racketeering for his connection to the gang. "The defendant's mandatory minimum term of incarceration would be 37 years' imprisonment," the document states.

Prosecutors filed a legal letter in the case outlining the reasons for such a high sentence, "The defendant was assessed one criminal history point...due to his October 26, 2018 sentence of four years' probation after having been convicted of "Use of a Child Less Than 17 Years of Age in a Sexual Performance," a class C Felony," the letter says.

6ix9ine was facing 47 years before he turned government witness. We guess we'll find out his final number on Wednesday.
