Earlier this week, Fulton County, Georgia dropped attempted murder and other charges against Lil Durk, who had been accused of shooting a man outside of the Varsity restaurant in Fulton County Georgia in February of 2019.
The man was injured and didn't die.
Police had said there were eyewitnesses and surveillance video tying Durk to the crime.
King Von was also arrested with the Durk and it appears the charges against Durk were ultimately pinned on Von, who was shot to death in Atlanta in an unrelated incident in 2020.
“The office has declined to indict Durk Banks, a.k.a. ‘Lil Durk’ for the February 5, 2019 incident because insufficient evidence exists to prove his guilt beyond reasonable doubt of a trial," Fulton County District Attorney Fani Willis's rep Jeff DiSantis told the press. "If co-defendant Dayvon Bennett, a.k.a. ‘King Von,’ had not died in 2020, he would have been indicted for this incident. As stated in the motion declining to indict Mr. Banks, the Atlanta Police Department had evidence to establish probable cause to arrest him.”
Durk's lawyers have argued that Durk was with Von when Von "decided" to shoot someone, but otherwise had nothing to do with the shooting.
