Kanye West has been trying to sue YouTube co-founder Chad Hurley for taping Ye's baseball stadium marriage proposal to Kim Kardashian and then putting the clip on his new video sharing site before it had the chance to run on E!.

Yesterday, a California appeals court ruled that Hurley did violate a confidentially agreement and the suit could go forward.

Hurley allegedly snuck into San Francisco’s AT&T Park in October of 2013 when West was preparing to propose to Kardashian on her 33rd birthday. He was allowed to stay only if he signed a confidentially agreement.

However, West said Hurley then violated the agreement when he put a clip of the proposal on his fledgling video site, MixBit. Because the video was leaked, it ruined the exclusivity E!’s Keeping Up With The Kardashians was supposed to have of the big moment.

Hurley has argued that a confidentiality agreement he signed was not binding on MixBit.

No word on how much money 'Ye is seeking, but given the resources of both parties this could be quite the legal battle.
