Kerry Lathan was hit in the back during the incident which took Nipsey Hussle's life.
Because the 56-year-old was on probation for a murder charge that he had recently finished a 25-year bid for, he was then arrested for consorting with a gang member -- Rollin 60's Crip Nipsey.
Lathan insisted that he didn't really know Nipsey and had just run into him outside of Nip's Marathon Clothing store and asked him about a clothing item which wasn't in stock. Minutes later, Eric Holder arrived with his gun blazing.
This contradicts the reports that Nipsey had taken Lathan to the store to buy him clothing. (Seven months prior, when Lathan got out, he received a care package of new clothing from Nipsey. This is something Nip is said to do for all of the neighborhood Gs when they get out after serving a long bid.)
The whole thing seemed pretty unfair to Lathan, who is now in a wheelchair because of his back injuries. Fortunately, it looks like somebody in the California Corrections and Rehabilitation department agreed that Lathan was getting a very raw deal.
A rep with L.A. Superior Court has told TMZ that the Department just withdrew its petition to revoke his parole, making Lathan a free man as of later today.
