XXXTentacion and Lil Peep Sued For Stealing 'Falling Down'

Richard Jaden Hoff, who uses the stage name K.i.R.O. is suing Lil Peep and XXXTentacion for stealing the guitar riff on his 2018 Soundcloud track "Under My Breath", speeding it up, and sticking it in their hit "Falling Down."

What makes this case odd is the timing

XXX was shot to death five days after Hoff put "Under My Breath" on Soundcloud whereas Peep was already dead from an overdose when he did.

"Falling Down" was featured on Peep's posthumous album Come Over When You're Sober, Pt. 2.  There is little chance XXX ever knew the "Falling Down" had used Hoff's riff (if it did) and it would have been impossible for Peep to have known.

Yet, Hoff is suing XXX and Peep, not their estates or the song's producers and references them both in the current tense in the lawsuit.

This suggests he might not know they are both dead
